Also - this Thursday at 9am AWST, we have our quarterly PAP (Project Assessment Plan) meeting for the s. 22(1)(a)(ii) s. 22(1)(a)(ii) Would you like to attend the meeting on 22(1)(a)(ii) behalf? I've yet to receive a confirmation from s. 22(1)(a)(ii) We can postpone the meeting to next week if preferred.

AMCS is seeking advice on what is the appropriate contact point at the department to seek an extension for the submission deadline to the Browse Carbon Capture and Storage Project (EPBC Number: 2024/10028) Referral Decision - Open for Public Comment till January 16, 2025.
Due to the complex and novel nature of this CCS proposal, the number of MNES involved and having the public comment period commencing on January 2, 2025 during a period of time when many relevant and interested persons were not able to engage with this process, we would welcome the opportunity for an extension to allow those with an interest in this proposal to make a full and considered response.
I would appreciate any advice on who is best to contact for this request as the deadline for this submission

Thanks for the chat earlier. Just confirming our discussion that a decision on the Browse CCS referral will not be delivered today.
As you will recall, the department wrote to Woodside on 28 January 2025 seeking agreement for an extension of time to the statutory decision-making timeframe, which was originally 31 January 2025. In the letter, the department proposed 21 February 2025 as a delivery date for the decision. The department did not receive a response from Woodside on this matter until 4 February 2025 which was after the statutory timeframe for a decision had elapsed. For all intents and purposes, this rendered the decision as a later decision, meaning that there is no longer a formal statutory timeframe on this referral decision.
That being said and with best endeavours, the department has been working on the referral decision package over the last several weeks amongst competing priorities with the s. 22(1)(a)(ii) and will continue to work on this referral package over the next couple of weeks to progress it through the system for decision.
As we have advised previously, we can't foreshadow the decision-maker's decision, but I can advise that at this stage, we have enough information to progress the decision and don't envisage having to request anything further from Woodside in relation to this. We will certainly reach out promptly if we do.

Thank you for your correspondence dated 28 January 2025 addressed to Browse Environment Manager
s. 22(1)(a)(ii) seeking an extension of the timeframe for a referral decision on Woodside's proposal to transport, inject and permanently sequester up to 4 million tonnes of carbon dioxide (CO2) per year into the Calliance Storage Formation.
I note that DCCEEW released the Browse CCS referral for public comment on 2 January 2025, seeking feedback on whether the action should be determined a controlled action or not.
We understand the statutory timeframe for this public comment period under the EPBC Act 1999 is ten business days, with a decision under s. 75(1) of the EPBC Act to be made within 20 business days after the referral was received. While we appreciate DCCEEW has received a large volume of public comments in this initial timeframe, we are disappointed that Woodside was not afforded the opportunity for engagement prior to the public comment period being extended.
While we respect the decision to extend the public comment period in this instance, we also acknowledge the initial public comment period is limited to informing the decision regarding whether the Browse CCS Project is a controlled action. We understand that should the referral be deemed a controlled action, depending on the level of assessment set, there will be a number of further opportunities for public comment in addition to the stakeholder engagement already undertaken by Woodside in respect of the proposal prior to referral.
Your correspondence indicates that DCCEEW received a large volume of responses in the initial period. As the extension of time will generate further responses, I would appreciate your assurance that DCCEEW has the necessary resources to address the public comments in a manner that supports a decision by the 21 February, as per your proposal.
In future, please direct all correspondence in relation to the Browse CCS Project proposal to me as proponent.

# **Follow up on request to Extend Timeframe for Referral Decision on Browse Carbon and Capture Storage Project**
Dear s. 22(1)(a)(ii)
I am writing to you in relation to Woodside Energy Limited’s proposal to transport, inject and permanently sequester up to 4 million tonnes of carbon dioxide (CO₂) per year into the Calliance Storage Formation, Indian Ocean, Western Australia (WA).
On 21 January 2025, the department met with Woodside Energy to discuss the Browse Carbon and Capture Storage Project (EPBC 2024/10028) and the need for extending the timeframe for a referral decision. This letter outlines a formal request to Woodside Energy for the extension.
As discussed, the department has received a large volume of public comments on the referral decision. Furthermore, the public comment period was extended by 10 business days until 31 January 2025 which is the current due date for a referral decision. To ensure the decision maker has enough time to consider the public comments, the department requests your agreement to an extension of timeframe.
Under section 74(3)(b) of the EPBC Act the Minister must publish the referral for public comment. This is published to seek the public’s comment on whether the action should be determined a controlled action or not. Public comment on the level of assessment is not deliberately sought at this stage of the process, however the public can provide a general comment on the referral.
Under section 75(7) of the EPBC Act, the department seeks a mutual agreement of a timeframe extension to Friday 21 February 2025. This will allow the decision maker adequate time to consider public comments as required by section 75(1A) of the EPBC Act. If Woodside Energy wish to submit a comment, they may do so through the public portal, this can include a comment on the assessment approach. We would appreciate your response by 30 January 2025.

That is our understanding too. It is currently in validation, however there is no update on when this is likely to be completed. The validation team may seek further information from Woodside to ensure the referral is valid.
Just so you are aware the below has been put out by our referral Gateways team also:
The Department will be closed between 25 December 2024 and Wednesday 1 January 2025. Any referral applications found valid under the EPBC Act between Monday 9 December and Tuesday 24 December 2024 will be published after the Department resumes operations on Thursday 2 January 2025.
